Terms of service

These terms are a contract between you and In Your DM (operating entity to be confirmed). Nothing in them removes rights your national consumer law gives you.

1. What the service does

In Your DM watches the comments on Instagram posts you have connected, and when a comment matches a keyword you configured, posts a public reply you wrote and sends the commenter a direct message you wrote. It uses Meta’s official API.

You write the messages. You choose the keywords. We deliver them. That division decides who is responsible for what throughout these terms.

2. Eligibility and your account

  • You must be 18 or the age of majority where you live.
  • You need an Instagram professional (Business or Creator) account linked to a Facebook Page you are authorised to manage.
  • You are responsible for keeping your password secure and for everything done under your account.
  • One person or organisation per account. Sharing credentials across a team is what seats are for.

3. Acceptable use

You must not use In Your DM to:

  • send unsolicited bulk messages, or message anyone who has asked you to stop
  • impersonate another person, brand or organisation
  • distribute malware, phishing links, or content that is illegal where it is received
  • promote content that Meta prohibits, including regulated goods where the recipient is
  • operate an account you do not have permission to operate, or evade a restriction Meta has placed on any account
  • resell, sublicense or white-label the service except on a plan that permits it
  • reverse engineer the service, or use it to build a competing product
  • circumvent rate limits, quotas or plan restrictions

You must also comply with Meta’s Platform Terms, the Instagram Community Guidelines, and any anti-spam law that applies to you — including CAN-SPAM in the US, PECR in the UK, CASL in Canada and the ePrivacy Directive in the EU.

We will suspend an account that puts our Meta app at risk. A violation by one customer can end the service for every customer, and we will act quickly to prevent that. Where the situation allows, we will warn you first.

4. Your responsibilities as a sender

Messages sent through In Your DM come from your Instagram account, not from ours. You are the sender in the eyes of the law and of the recipient.

That means: you decide the content, you honour opt-outs, and you are the data controller for the people who comment on your posts. We process their data only to carry out your instructions, under the data processing addendum, which forms part of these terms.

5. Rate limits and delivery

Instagram enforces its own limits on how many messages an account may send, and it changes them without notice. We pace sends beneath those limits to protect your account, which means messages may be queued and delivered later during unusually high volume. Queued messages are not discarded.

We publish our latency targets and live performance on our status page. Those are targets measured from the moment Instagram’s webhook reaches us, and they are not a guarantee of delivery of any individual message. Instagram’s own delivery of the comment webhook takes between one and five seconds in normal conditions and considerably longer at peak, and no tool can change that.

6. Plans, billing and taxes

Plans are flat monthly or annual subscriptions in US dollars. There is no per-contact charge, no per-message charge and no overage. A post that performs well does not raise your bill.

Dodo Payments is our merchant of record and is the seller for your purchase. They calculate, collect and remit any VAT, GST or sales tax due where you are. Prices shown are exclusive of such taxes unless the checkout says otherwise; the exact amount is shown before you pay.

If you are a business with a valid VAT or GST registration number, enter it at checkout and the reverse charge will be applied where the rules allow.

Subscriptions renew automatically until cancelled. You can cancel at any time from Settings, in as few steps as it took to subscribe. Cancelling stops the next renewal; access continues to the end of the period already paid for.

7. Price changes

We may change prices with at least 30 days’ notice by email. A change never applies to a period you have already paid for. If you do not accept a new price, cancel before it takes effect.

8. Your data and ours

You own your content, your automations and your contact list. We claim no rights over them beyond what is needed to run the service for you.

You can export everything as JSON at any time from Settings, and delete everything from the same page. We do not hold your data hostage.

We own the service itself — the software, the interface and the brand. Nothing here transfers that to you.

9. Availability

We aim for high availability and publish real numbers rather than promises. We do not offer a contractual uptime SLA on self-serve plans. Planned maintenance is announced in advance where we can.

The service depends on Meta’s APIs. If Meta changes, restricts or withdraws access, the affected functionality may change or stop, and that is outside our control. If it becomes permanent we will tell you and refund any unused prepaid period.

10. Liability

The service is provided as is, without warranties beyond those your law makes unwaivable.

We are not liable for indirect, incidental or consequential losses, for lost profits, or for loss of data you could have exported. Our total liability for any claim is limited to the fees you paid in the three months before the claim arose.

Nothing in this section limits liability that cannot be limited by law — including death or personal injury caused by negligence, fraud, and, if you are a consumer in the EEA or the UK, your statutory rights.

11. Suspension and termination

You can stop at any time. We may suspend or terminate an account for a breach of section 3, for non-payment, or where required by law or by Meta. Where we terminate for reasons other than your breach, we refund the unused portion of any prepaid period.

After termination your data is retained for 30 days so you can export it, then deleted.

12. Changes to these terms

We will email you at least 30 days before a material change takes effect. If you do not accept it, cancel before the effective date and we will refund any unused prepaid period.

13. Governing law and disputes

These terms are governed by the laws of India, and its courts have jurisdiction.

If you are a consumer in the EEA, the UK, Switzerland, Australia or India, this does not deprive you of the protection of the mandatory laws of your own country, and you may bring proceedings in your local courts. EU consumers may also use the European Commission’s Online Dispute Resolution platform.
